The Lemon Law in Los Angeles, California

What is a warranty?

The definition of a warranty is an acknowledgment by the manufacturer or seller that they did not make a perfect vehicle or good. It is a given that no car or good is perfect. As a result, manufacturers or sellers issue a warranty or promise to repair the goods if anything goes wrong during a specific period. Warranty periods do differ by manufacturer or seller. They can also be anywhere from one to six months.

What are Lemon Laws?

Lemon Laws are state and federal consumer protection guidelines that protect consumers who purchase defective vehicles or goods. Under the law, when a manufacturer cannot repair a car or other consumer goods after a reasonable number of tries, they must either replace the defective product or refund the consumer.

If your vehicle or good qualifies as a lemon, you have the right to receive a replacement or refund. A replacement or refund consists of your down payment, monthly payments, registration, taxes and incidental expenses, and even attorneys; fees and costs. The manufacturer can deduct a usage fee for the value of the miles on the vehicle. This can take place up to the onset of its first repairs.

What is a Lemon Law Buyback?

We call it a Lemon Law Buyback when the manufacturer repurchases your vehicle because it is a lemon. Repurchases consist of a refund of all the money you spend towards the purchase or lease of your lemon vehicle. Again, this includes down payments and a prorated portion of registration minus a usage fee. When you drive the car, so to speak, “trouble-free,” that falls under the usage fee. Repurchases also include reimbursement for any expenses you experience due to your lemon. Finally, under the lemon law, buyback pays off your loan balance on your vehicle. 

What is a vehicle replacement?

Exactly what it sounds like, where you receive a vehicle similar to your lemon’s make and model. Nine times out of ten, though, the replacement will be a vehicle in the current model. Your current loan amount remains the same and for the same duration as the original loan or lease. The only expense you have is to pay for the time before your vehicle becomes a lemon.

To expand more on the Lemon Law, it does apply to a used car. Used cars can and often qualify under the lemon laws as long as they sell with a written warranty. Plenty of times, used vehicles sell while still under the manufacturer’s warranty or warranty from the dealer. Your used car may qualify under lemon laws if this applies personally to you.

In addition to your used vehicle, the Lemon Law also applies to a leased vehicle. Leased cars in California have coverage as long as you lease the vehicle with a warranty.

The Lemon Law Presumption in California

In California, your vehicle is a lemon if any of the following occur during the first 18 months or 18,000 miles of purchasing or leasing your car.

  • Four or more repair attempts for the same issue
  • Two or more repair attempts to fix a problem that could cause injury or death
  • Your car has been out of service for more than 30 days for any repairs.
